BRACE RITEā„¢ Mobile Application Privacy Policy

Your privacy is important to us at Texas Scottish Rite Hospital for Children (“Owner”, “we”, “us”, or “our”). We know that you care about the use of your personal information and how it shared. Because of this, we will not use or share your information except as set forth in this Privacy Policy.

This Privacy Policy explains what information we collect about you on our Brace Rite mobile application, how we use such information, and the safeguards we have in place to protect it. Please carefully read this Privacy Policy, which is part of our End User License Agreement, before using the Brace Rite Mobile Application (the “Services” or “App”).

By installing, using, registering to or otherwise accessing any Services, you agree to this Privacy Policy and give an explicit and informed consent to the collection, use and processing of your personal data in accordance with this Privacy Policy. If you do not agree to this Privacy Policy, please do not visit, install, use, register to or otherwise access the Services.

Owner reserves the right to modify this Privacy Policy at any time, so please review it frequently. Your continued use of the Services constitutes your acceptance to this Privacy Policy and any updates. Policy changes will apply only to information collected after the date of the change. Information We Collect

When you register for Owner’s Services, we also may ask you for certain information, including, but not limited to, your name, e-mail address, and telephone number to register your device. This information is provided by you and used by Owner to provide the Services, including pairing the App with the Brace Rite sensor and relaying sensor information to your device.

When you access the Services by or through a mobile device, we may access, collect, monitor and/or remotely store “device information”, which may include: (i) browser or device properties, including, but not limited to IP address, browser types, mobile network information, device telephone number, and unique device identifier or other device identifier (“UDID”); (ii) device software platform and firmware; (iii) mobile phone carrier; (iv) metadata and other information associated with other files stored on your device; (v) other non-personal data as reasonably required by Owner to enhance the Services. Some features of the Services may not function properly if use or availability of Bluetooth is impaired or disabled. We may maintain a database with anonymized device information and may keep such information indefinitely to improve our Services and to provide other features that may enhance your service capabilities, functions, and your user experience.

If you do not want us to collect this information to provide you with the Services, do not download or use the Services, or delete them from your device.

Cookies and Tracking Technologies

Owner uses tracking technologies in order to improve our Services by providing aggregate information on the number of users and usage patterns. Owner does not engage in the collection of personally identifiable information over time and across third-party websites and we do not permit third parties to gather information passively on our Services for behavioral advertising purposes.]

How We Use the Information We Collect

We use information that we collect about you or that you provide to us, including any personal information:

By registering for the Services you authorize Owner to send you a two-factor authentication code via text message at the telephone number(s) you provided to Owner. You understand that these text messages may be sent unencrypted or over an open network. You understand that such unencrypted text messages are inherently unsecure, and there is no assurance of confidentiality of information communicated in either manner.  

You certify that you are the user and/or subscriber of the telephone number provided, and you accept full responsibility for text messages sent to such number. You agree to hold Owner harmless from any and all claims and liabilities arising from or related to the two-factor authentication code sent via text message to the telephone number provided by you.

You understand that this authorization will remain valid and in effect until you revoke it, and you agree to update the phone number provided in the event the number changes.

Sharing Your Information

Owner does not sell, trade, or disclose your personal information with third parties for their direct marketing purposes.

We use HIPAA-compliant AWS servers from to host the App data.

Opt-Out Procedures; Removing Information

If you do not wish to have your contact information used by Owner to provide the Services as set forth herein, please delete the App from your device.

We will keep your personal information for as long as necessary for the purposes described above or as long as we are required by law. After this your personal information will be deleted. We cannot remove your personal information when there is a legal storage requirement or when there are other legal grounds to keep the data.

Information Security

Owner has implemented security measures to help protect against the risk of loss, misuse, and alteration of sensitive information that you provide. Nevertheless, such security measures may not prevent all loss, misuse, or alteration of information on the Services, and Owner is not responsible for any damages or liabilities relating to any such security failures. By using the Services, you understand that there is a risk that data and communications may be accessed by unauthorized third parties when communicated over the Internet. The foregoing does not affect any liability which cannot be excluded or limited under applicable law.

Accessing and Correcting Your Information

You may have the right to access the personal data that we hold about you and to request that we correct, amend, or delete it if it is inaccurate or processed in violation of applicable law. These access rights may not apply in some cases, including where providing access is unreasonably burdensome or expensive under the circumstances or where it would violate the rights of someone other than the individual requesting access. Owner App users may review or modify their contact information by contacting customer service at bracerite@tsrhc.org. We may request specific information from you to confirm your identity. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Your California Privacy Rights

Under California law, a California resident with whom Owner has an established relationship has the right to request certain information with respect to the types of personal information Owner has shared with third parties for their direct marketing purposes (if any), and the identities of those third parties, within the immediately preceding calendar year, subject to certain exceptions. In response to a written request, Owner is allowed to provide a cost-free means to opt-out of such sharing.

Transfer of Information to the United States

The Services are operated in the United States and is intended for users located in the United States. If you are located anywhere outside of the United States, please be aware that information we collect, including personal information, will be transferred to, processed, and stored in the United States. By using the Services or providing us with any information, you consent to the transfer, processing, and storage of your information in the United States. You are also consenting to the application of United States federal and Texas state law in all matters concerning the Services and this Privacy Policy.

Information of Children

Our Services are not directed to children under the age of 13 years. We will not request personally identifiable information from anyone whom we know to be under the age of 13. By registering and using our Services, you represent and warrant that you are at least 13 years old. If we become aware that a user is under the age of 13 and has registered without prior verifiable parental consent, we will remove his or her personally identifiable registration information.

Changes to our Privacy Policy

This Privacy Policy was posted on March 1, 2019. Owner reserves the right to change, modify, or amend this Privacy Policy at any time. When the Privacy Policy is changed, modified, or amended, the revised Privacy Policy will be posted on the Services. Users are responsible for periodically checking the Privacy Policy available in the Services for updates. Continued use of the Services following any changes or modifications shall be deemed as your acceptance of any changes in the terms of the Privacy Policy.
